Please read the following important terms and conditions before you rent any equipment from us and check that they contain everything you want and nothing that you are not willing to agree to.

Summary of some of your key rights:

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that in most cases, you can cancel within 14 days. If you agree the proposed rental will start within this time, you may be charged for the rental equipment.

The Consumer Rights Act 2015 says you can ask us to refund the price of or replace any rental equipment if it's not working as expected.

You also promise us that you can safely use the rental equipment in accordance with the manufacturers' instructions for the rental equipment and for what use it was designed. You acknowledge that you are responsible for obtaining these instructions and we are not providing you with these instructions.

We have also limited our liability towards you:

  • we are not responsible for providing any instructions on how to use the rental equipment; you remain wholly responsible for sourcing these instructions, ensuring you understand how to use it safely and in accordance with any manufacturer's instructions

  • we are not liable for any damage caused by the rental equipment that arises from your unsafe use of it or not using it in accordance with the manufacturer's instructions

  • other than of personal injury or fraud, we have limited our liability to you to [INSERT] for damage to your property if it is caused by us providing you with faulty equipment

  1. ABOUT US
    We are The Doddridge Centre Limited, a company limited by guarantee registered in England and Wales under company number: 05830381 and a registered charity, charity number 1118283. Our registered office is at 109 St James Road, Northampton, NN5 5LD.
  2. THESE TERMS
    1. Overview: We provide a rental equipment service 'Borrow Hub' which enables you to rent equipment from us for periods of time subject to an active membership and then an further fees and compliance with these terms. The reservation of equipment is only available via our website www.doddridgecentre.org.ukWe do not sell any equipment.
    2. Terms and conditions: A copy of these terms are available on the website and you will be required to accept them each time you rent equipment. Please read these carefully before you reserve rental equipment, as they set out important information about your and our rights and obligations. Please print out or save a copy of these terms and any emails from us for your records, as we will not save or file a copy for you. These terms are only available in English.
    3. Definitions: Any reference to:
      1. 'we', 'us' or 'our' in these terms is to The Doddridge Centre Limited, and any reference to 'you' or 'your' is to the person placing a request on our website;
      2. 'your reservation' or 'reservation' in these terms means the reservation made by you on our website (or where we permit it, made otherwise) to rent equipment;
      3. 'terms', 'these terms', the 'terms' means these terms and conditions which also incorporates any documents that are referenced within these terms, such as any privacy policy and website terms of use;
      4. 'rental equipment' means the list of equipment made available for rental by us on our website;
    4. Right to vary these terms: We may make changes to these terms at any time. Updated versions will be made available on the website and you will be notified either by email or via the website. The onus is upon you make sure you are aware of the latest terms.
    5. Acceptance of varied terms: You accept the variations of these terms with your continued use of the Borrow Hub. The terms which apply to your use of the Borrow Hub will be those in force at the time you at the date when we have accepted the reservation for the rental equipment.
    6. Consumers and Business customers: For the purposes of these terms, you are a 'consumer' if you are renting equipment as an individual for purposes wholly or mainly outside of your trade, business, craft or profession. You are a 'business customer' if you are buying renting equipment for purposes relating to your trade, business, craft or profession. Some terms only apply if you are a consumer and other terms only apply if you are a business customer, so please make sure you read these terms carefully. You will be required to confirm if you are business customer at the point of each rental of equipment.
    7. Your use of our website including the creation and maintaining of an account and membership is governed by our Website Terms of Use and these terms www.doddridgecentre.org.uk.
  3. RENTING RENTAL EQUIPMENT
    1. Scope:
      1. The full range of rental equipment with prices are available on our website.
      2. We will provide the rental equipment at the time(s) and on the date(s) reserved by you on the website. The period of rental will be from the date of collection until it is returned.
      3. All equipment rental is on a first-come first-served basis.
      4. Consumables: We do not provide or sell any consumables with or without the rental equipment. 'Consumables' are items that are used with rental equipment and have to replaced, for example cleaning fluids. Where some items are provided with consumables such as a battery or fuel then that is provided incidentally to the equipment and not included as part of the rental equipment. All consumables are excluded from the actual rental. Where the consumable needs to be replaced during any rental period, then you have to replace it yourself. We will not reimburse you for any consumables that you have purchased and returned with the rental equipment.
      5. We do not sell any equipment. Ownership remains with us at all times.
    2. Pre-conditions: In order to reserve rental equipment:
      1. You must be at least 18 years old and a resident of the UK to place reserve and rent the rental equipment.
      2. You must have an up to date and registered form of payment on your membership which is valid and where applicable has adequate funds to pay for any rental equipment and rental period.
      3. You must be a registered member of us which is valid, fully paid up at both the date of your reservation and for the period of rental.
      4. If you are a business customer placing a reservation on behalf of a business, you confirm that you have authority to place such reservation and rent rental equipment on behalf of that business.
    3. Reservation:
      1. You have to make reservations online via our website and you will need to create an online account which we will either approve manually or automatically. Online accounts are only available to those with active memberships.
      2. Only you, the named account holder and member is entitled to use the Borrow Hub. You will not permit the rental equipment to be used by anyone else unless we have given express consent in writing prior to you making your reservation and renting the rental equipment. We may impose conditions in relation to any consent we grant.
      3. You must check any reservation carefully and correct any errors before you submit it to us. You must check to ensure that whatever rental equipment you rent from us is suitable for your needs, any specific purpose you intent to use it for and you understand how to operate such rental equipment safely and in accordance with the manufacturer's operating manuals and guidance. We may make some manuals or other instructions available. We do not provide any training or guidance on how to use the rental equipment. rental Equipment is used at your own risk.
      4. After you place your request, we will send you an acknowledgment email to let you know that we have received your request. This does not mean that your request has been accepted by us. Your request is an offer to rent equipment from us on these terms. Acceptance of your request by us only takes place when we send you a confirmation email.
    4. Restrictions: you can:
      1. reserve rental equipment up to 3 months in advance of your desired commencement date of the rental period
      2. not rent more than 5 (five) different pieces of rental equipment in any one rental request
      3. not rent rental equipment for greater than a maximum period of 1 (one) week in one rental request
      4. not rent rental equipment on behalf of any third person who is either another member or non-member; you are able to use a third-party for collection (see below) but you remain the person responsible for the equipment including payment of the rental price plus any additional fees incurred
      5. not rent rental equipment by a period less than a day which begins no earlier than 09:00 and no later than 15:00.
    5. Making changes to your reservation: If you would like to make any changes to your reservation after you have submitted it but prior to 24 hours before the day of collection, please contact us as soon as possible and we will let you know if it is possible to change your reservation. See below for cancellation of a reservation.
    6. Availability: All reservations for rental equipment are subject to availability. We do not guarantee that any rental equipment will be available at any given time even after we have confirmed your reservation. For example, the previous renter may not have returned the rental equipment, or it has been damaged or it requires cleaning or there has been a change in law that means we cannot provide the rental equipment or the Borrow Hub as a whole.
    7. Rejection: If we do not confirm your reservation, for example because we are unable to take payment, or the rental equipment is unavailable, or you are under 18 or live outside of the UK, you are not a member or there has been a mistake regarding the pricing or description of the rental equipment, we will email you using the details you provided when you placed your reservation and linked with your membership.
    8. Contract: When you reserve rental equipment online via our website, you are submitting a request or offer to reserve the rental equipment. We will send you a confirmation email of such request which is not an acceptance of such request or offer. We will then, take payment and only once we have confirmed by email payment for the relevant reservation will a contract between us has been formed.
  4. COLLECTION
    1. All equipment will be collected and delivered from The Doddridge Centre, 109 St James Road, Northampton, NN5 5LD and must be collected by 15:00 on the date specified in the request and only on the certain days during the week. We do not deliver or collect any rental equipment. You remain responsible at all times to collect and return.
    2. We will only release rental equipment to you upon proof of ID to prove that you are the account holder who submitted the request which was subsequently accepted. You will be asked to sign off an inspection of the rental equipment to identify any visible damage or restrictions on functionality before the rental equipment will be released to you.
    3. Third party collection: You are entitled to send another person in your place, your 'proxy' who is able to collect the rental equipment (and/or return the rental equipment). In these circumstances you must inform us of the name of the proxy. The proxy will need to demonstrate proof of their identity at collection before we release the rental equipment. To be clear if you ask another member to collect an item from you with our consent, then you will remain responsible for the rental equipment under these terms.
    4. Non-collection: Failing to collect any rental equipment by 3pm on the date it is due to be collected means the reservation will be cancelled and the rental equipment made available for reservation by others. You will not be entitled to a refund for any fees paid for that rental equipment in these circumstances.
    5. Delay/cancellation of collection date:
      1. We will do what we reasonably can to ensure that the rental equipment is available for collection on the date and time as set out in your reservation. However, you recognise that we are not in control of when rental equipment is returned to us or the state in which it is returned to us. In those circumstances we may have to cancel or delay any collection date or time.
      2. Where a delay is caused by circumstances beyond our reasonable control, we will usually contact you to rearrange the collection time and we will offer you the option to either accepting the rearranged time or date or to cancel your reservation and get a full refund of any payments made by you for that rental equipment that is not available for collection as per the reservation. If your reservation includes multiple items then any items that are part of that reservation will still be available for collection.
    6. If there might be a delay or cancellation, we will email you to let you know as soon as reasonably possible. However, we are not liable to you for any losses you incur as a result of any delay caused by circumstances beyond our reasonable control.
    7. Delivery: We do not offer delivery services in place of collection from or return to our premises..
    8. Extensions of rental period
      1. You may up to 24 hours/1 days before the return date as set out in the reservation extend the rental of your rental equipment beyond the original rental period subject to availability. If the rental equipment is already reserved by other members then you will not be able to extend any rental period and will be required to return it as per the original reservation.
      2. If you wish to extend any rental [procedure] then this will be treated as a new reservation and the procedure remains the same.
      3. Any extensions are subject to availability and are not guaranteed. We reserve the right to refuse and/or limit any request to extend to maximise the availability of the rental equipment to others.
      4. Any extensions to the rental period will be treated as a wholly separate contract (formed as detailed above under sub-clause labelled 'Contract').
  5. RETURN
    1. All rental equipment including parts, other items and any packaging that came with the equipment must be returned in good repair except for reasonable wear and tear. Any consumables that came with the rental equipment will also be replaced.
    2. You must also return the rental equipment in a clean state. We reserve to provide further guidance available on our website on what we expect from you when returning the equipment.
    3. We reserve the right to undertake an inspection of the rental equipment before accepting its return. Such inspection may include completing a form and/or taking photos or a video. Any check will be made against any inspection form we prepared on the date when the equipment was rented. You acknowledge and accept our assessment of the state of the rental equipment, any damage, delinquency, and/or loss of rental equipment in part or in total and the corresponding charges that we may impose upon you (and if applicable deduct from any deposit in accordance with these terms).
    4. Where we have determined that you have failed to return the equipment in a clean state or a state of good repair, then you authorise us to impose a charge for the relevant amounts from the payment method on your account.
    5. Upon satisfactory return and if we have also collected a deposit, we will then process any refund or cancel any payments made as a deposit or otherwise.
  6. PRICES AND PAYMENT
    1. Prices: Prices for the rental equipment are set out on our website. All prices are in pounds sterling (£)(GBP) and include VAT if applicable and at the applicable rate at the time.
    2. Discounts: We may provide discounts from time to time on the published price for rental equipment under these terms. Where we provide such discounts we will also provide further details on the criteria and conditions for you to benefit from such discounts. However, any discounts will not apply to any other charges you may incur for example the Supplement Fee, late return fee, etc.
    3. Payment provider: Our website currently accepts payment via credit card. We accept the following credit cards and debit cards: Visa, Mastercard and American Express. You can also pay by Apple Pay and Google Pay. All credit card and debit card payments need to be authorised by the relevant card issuer.
    4. Cash: We do not accept cash payments for reservations.
    5. Payment in advance: We require an advance payment of the total period of rental for the rental equipment when you make your reservation. Any acceptance of a reservation by us will be conditional upon receipt of cleared funds from you. We will take this payment from your card before we send you your confirmation email. If the payment is unsuccessful, we will try to contact you using the contact details you provided when you placed your request. If we are unable to contact you, we will cancel your request and notify you by email.
    6. Deposit: We expressly reserve the right at any time to require you to provide a deposit against any or all rentals made under these terms. If we determine that a deposit is required and we have consequently taken a deposit against your rental then at the time of payment you agree to and give authority to us to deduct amounts from the deposit to cover any additional charges (including from previous rentals) you have incurred and an amount which equals the value of replacing the replacing equipment on a new basis in the event of damage, loss or theft of the equipment whilst you have such equipment. Where we intend to make such a deduction we will give you notice.
    7. Right to vary prices: Prices for the rental equipment may change at any time. Except as set out below for errors, such changes will not affect existing reservations. You should check the prices on the website on a regular basis to ensure you are aware of the current price.
    8. Errors: If there has been an error on the website regarding the pricing of any of the rental equipment and this affects your reservation, we will try to contact you using your contact details on your membership. We will give you the option to re-confirm your request at the correct price or to cancel your reservation. If we are unable to contact you, we will treat the reservation as cancelled and notify you by email.
    9. Other charges: We reserve the right to request any or all of the following:
      1. Supplement Fees
      2. Late return fees
      3. Cleaning charges
      4. Repair fees
      5. Replacement charges for damaged beyond repair, lost or stolen equipment
    10. Supplement fee: You agree to pay any Extra Item Supplement fee of £2.50 per item per loan for any additional items reserved over the membership allowance for items checked out at the same time regardless of if the items are separate or slightly differing reservations. We reserve the right to change this Supplement fee at any time.
    11. Late return: A 'late return' is when the rental equipment is returned after the date it is due to be returned which means after 15:00 on the date of return. All late returns will incur additional charges which include the list price per day of rental plus £2.00 per day it is late with such additional charge being the agreed loss we incur arising from you not returning the rental equipment before 15:00 on the day of return. We reserve the right to amend this daily charge upon reasonable notice at any time.
    12. Cleaning fees: In the event that you do not return rental equipment in a clean state then we reserve the right to impose a cleaning charge of £5 or such other charge as we may consider reasonably appropriate from time to time depending on the state of the equipment and how much additional work is needed to clean.
    13. Repairs fees: the fault for the rental equipment being DAMAGED is deemed to be your fault unless you provide such evidence to the contrary. Where rental equipment is returned damaged then we will undertake an assessment of the damaged equipment to see if it can be repaired and if so the costs of such repair. If we can repair the damage then you will be liable for the costs of such repairs. We reserve the right to use a third party to undertake such repairs and you will also be liable for the costs of such repairs. Where the equipment is beyond repair or it is not economically viable to undertake such repairs then you will be liable for the costs of replacing that equipment on a new basis.
    14. Lost equipment: Where the rental equipment is lost, you are obliged to notify us as soon as possible and provide such information that we require to explain the circumstances in which the equipment was lost. If we request it, we may also require any additional evidence from you to support your claim that the equipment was lost. the fault for the rental equipment being lost is deemed to be your fault unless you provide such evidence to the contrary.
    15. Stolen equipment: Where the rental equipment is stolen then you are obliged to inform the police and obtain a police incident report number. You must share such incident number with us for our own insurance so that we may make a claim. If you do not have a police report then the rental equipment will be deemed lost and you will be responsible as per the above sub-clause 'Lost Equipment'.
    16. Outstanding balances: Where you have incurred any or all of the above additional charges we reserve the right to add these sums to your membership and accordingly block any further rentals until such time as these sums have been cleared.
    17. Your authorisation: We reserve the right to charge any of the above additional fees and costs against your registered payment method and you expressly authorise us to raise a charge against your registered payment method to make payment for these outstanding charges. If we have taken a deposit, then you authorise us to deduct such fees and costs from your deposit.
  7. YOUR OBLIGATIONS
    1. You have to:
      1. ensure that you know how to use the rental equipment safely, generally and in accordance with the manufacturer's operation manual and recommendations; you may be asked to sign a statement and disclaimer prior to collection to affirm that you know how to use the rental equipment
      2. provide all consumables that the rental equipment needs to operate safely and in accordance with the operation manual
      3. replace any consumables that come provided with the rental equipment
      4. return all rental equipment and packaging that we provide
      5. keep the rental equipment clean and ensure that it is properly cleaned upon return
      6. use the rental equipment only for personal use and not for any commercial purposes
      7. return all rental equipment before 15:00 on the day of return, the last day of rental after which it will be deemed a later return
      8. store the rental equipment in a safe, secure, watertight place ensuring that it is clear that the rental equipment is our property
      9. not deface, remove or in any other way tamper with any mark or sign that indicates that the rental equipment belongs to us
      10. will wear Personal Protective Equipment (PPE) where appropriate, including, but not limited to, eye protection, ear protection, gloves, appropriate footwear, etc.
    2. Instructions to use: We are not obliged to provide any instructions manuals with the rental equipment. Where we do provide a manual on a case by case basis, we do not offer any warranty or representation that manual is complete or accurate. You acknowledge and accept that we are not in a position to know how each piece of rental equipment works nor given you instructions on how to use it; any assistance our employees or volunteers provide is provided from goodwill and without liability or warranty. You must obtain all manuals for the rental equipment yourself.
    3. Initial Inspection:
      1. Each time you rent rental equipment under these terms you must check it visually before taking it and make other checks for any faults that you may be able to identify before using it. You agree that if any rental equipment becomes unsafe or in a state of disrepair, you must immediately discontinue the use of the rental equipment and notify us on return. You may be asked to sign an inspection sheet at the point of collection.
      2. When borrowing electrical rental equipment, you must check the visible wires and plug for any damage before use. If you are using the rental equipment outside (where it is intended for use outside), moving it about, or using it in circumstances where it may encounter water, anything sharp or other electrical wiring, a circuit breaker must be used. You must take ALL necessary precautions when using the rental equipment.
    4. You further warrant that you have read and fully understand your requirements as set out in these terms, and you understand that failure to comply with any of these rules may result in temporary or permanent suspension of your membership and/or legal action against you. You may be asked to sign a liability waiver and indemnification form, at the point of collection.
    5. Liability: As the named member you remain liable to us for the rental equipment under these terms. This liability continues to be the case when you have arranged a proxy to collect and return any rental equipment, and with or without our consent, you permit a third party to use the rental equipment.
    6. Warranty (1): You warrant and continue to warrant that all information you have provided as part of the membership is complete, accurate and will remain as long as that membership remains active. within a reasonable period that we may specify, You will provide such proof that WE request to verify any details.
    7. Warranty (2): You warrant and represent to us that you a) have no mental or physical incapacity that would affect your ability to use the rental equipment, b) are experienced in using the rental equipment, and c) are capable of using the rental equipment in a safe and proper manner.
    8. Warranty (3): If you are a business customer, you confirm that you are renting equipment for the purposes of your named business only and not for or on behalf of any third party.
  8. OUR RIGHTS TO CANCEL
    1. Specific reservation: We reserve the right to cancel any request upon notice at any point prior to collection of the rental equipment for any reason even after you have received the appropriate email confirming your reservation. We will notify you by email, cancel your reservation and provide you with a refund (if applicable) for any rental equipment requested but not yet collected. This right to a refund will not apply where we have cancelled as a result of a fault by you.
    2. Specific rental equipment: We reserve the right to remove any rental equipment from our website at any point for any reason even after you have received the appropriate email confirming your reservation. We will notify you by email, cancel your reservation and provide you with a refund (if applicable) for any rental equipment requested but not yet collected. This right to a refund will not apply where we have cancelled as a result of a fault by you.
    3. The Borrow Hub: We reserve the right to cancel at any point and for any reason the parts of or the entire Borrow Hub. We will notify all members by email and on our website. Where you have a reservation then this may be cancelled as well in accordance with the above subclause labelled 'Specific reservation'.
  9. ENFORCEMENT
    1. We will contact you by email, telephone or such other method to notify you when the rental equipment is due for return and if it remains so after any return date.
    2. We reserve the right to take appropriate actions in order to recover any rental equipment that has not been returned by the due date. These actions include but not limited to:
      1. Suspend, ban or disallow you from making any further requests for equipment
      2. Suspend or permanently ban you from having a membership
      3. Cancel access to any wider services and facilities we may offer
      4. You grant consent to us to enter your premises and recover the rental equipment
      5. Take appropriate legal action to recover the rental equipment, the replacement costs of the rental equipment plus any other charges and costs we incur in taking such legal action
      6. Any other action that we deem appropriate taking into account all relevant circumstances
  10. YOUR CANCELLATION RIGHTSThis clause only applies to you if you are a consumer.
    1. 14-day right: Subject to the exception below, you have 14 days from the date from when we have accepted your reservation for rental equipment to change your mind and cancel your request.
    2. Exception to 14-day right: You will not be able to cancel your reservation if there are less than 14 days between the date when we have accepted your reservation and the date of collection. For clarity, any email that we send that confirms both your payment and your reservation via our website is our acceptance of the reservation. In this situation you will not be entitled to any refund even if there are 14 day period has not expired and you may still be required to pay for the full rental period or part of it.
    3. Notwithstanding the above, we are happy to provide a full refund up to 48 hours in advance the due collection date.
    4. To cancel your request, you can cancel it via your membership or if that is not functional please email us at info@doddridgecentre.org.uk or call us on 01604 586384. To help us process your cancellation more quickly, please have your details ready or include it in the email or cancellation form you send to us.
    5. We will provide you with a refund as soon as possible and no later than 14 days after the day on which you told us that you want to cancel. If any rental equipment has been provided during the cancellation period at your request, we will make deductions from any refund due to you as explained above.
    6. We will issue your refund to the same payment method you used when you placed your request.
  11. FAULTY SERVICE AND EQUIPMENTPart A - This only applies to you if you are a consumer.
    1. We must provide the Borrow Hub items to you with reasonable care and skill.
      1. If the Borrow Hub is not carried out with reasonable care and skill, does not meet any of the above standards then you can ask us to repeat the Borrow Hub or to fix it, or get some money back if we cannot fix it.
      2. We must also provide rental equipment of satisfactory quality and suitable for its intended purpose or any purpose you make known to us, the rental equipment matches the description as set out on our website and that we have the right to rent this rental equipment to you.
      3. If the rental equipment is not of satisfactory quality, not suitable for its intended purpose or any notified and accepted specific purpose, meets its description or we do not have the right to rent out the rental equipment then you can, then you are entitled to your statutory remedies which include:
        1. within a short period from when the rental began, cancel the rental and get a refund for any remaining period; you may also claim for other provable losses
        2. after any short period, you can ask us to repair or replace the rental equipment at no cost to you if either of these options are feasible and if not then you are entitled to a reduction in the price paid for the rental equipment or rejection of the rental equipment and a partial refund.
    2. This is a summary of some of your key rights. They are in addition to your cancellation rights set out in consumer cancellation rights clause above. For more detailed information on your rights, visit the Citizens Advice website at www.citizensadvice.org.uk or call 0808 223 1133.
    3. If there is a problem, please contact us as soon as reasonably possible either by telephone or by email. See the clause below on how to contact us.Part B - This only applies to you if you are a business customer
    4. Warranty: We warrant that the services and rental equipment will be:
      1. performed with reasonable care and skill within the meaning of section 13 of the Supply of Goods and Services Act 1982; and
      2. free from material defects at the time the services are completed
      3. rental equipment is of satisfactory quality and suitable for its intended purpose as detailed by the relevant manufacturer, the rental equipment matches the description as set out on our website and that we have the right to rent this rental equipment to you
    5. As your sole and exclusive remedy, we will (at our option) refund or re-provide alternative rental equipment that do not comply with above warranty, provided that:
      1. you notify us by email to info@doddridgecentre.org.uk within seven (7) calendar days from the date that we breached the above warranty or when you discovered the rental equipment did not meet the warranty ; and
      2. you provide us with sufficient information as to the nature and extent of the defects.
    6. Except as set out in this clause, we give no warranties and make no representations in relation to the services or rental equipment, and all warranties and conditions (including the conditions implied by sections 12–16 of the Supply of Goods and Services Act 1982 and any implied terms relating to the ability to achieve a particular result), whether express or implied by statute, common law or otherwise are excluded to the extent permitted by law.
  12. OUR LIABILITY
    1. We are not liable to you if we fail to comply with these terms because of circumstances beyond our reasonable control.

    Part A - This only applies to you if you are a consumer.

    1. Our liability: We are responsible to you for your foreseeable losses caused and damages caused by us and your use of the rental equipment or us breaching the term of the rental contract made in accordance with these terms. Your losses and damages are foreseeable if such loss or damage was obvious at the time the rental equipment was collected or you specifically drew our attention to it before you collected the rental equipment.
    2. The above includes liability for death or personal injury caused by our negligence, any fraud or fraudulent misrepresentation, or any matter for which we are not permitted by law to exclude or limit our liability. Accordingly, we are not liable to you for any loss or damage that was not foreseeable, or any loss or damage not caused by our breach or negligence.
    3. Business losses: Your use of the rental equipment is solely for personal use and not for commercial use. We are therefore not liable for any business loss or damage, for example any loss of profit, loss of business, business interruption, or loss of business opportunity.
    4. Disclaimer: We are not liable to you for any damage to property arising from your negligent use of or failure to use any rental equipment safely or in accordance with any manufacturer's instructions or using the rental equipment for any other purpose than it is designed and intended to be used for.
    5. Limitation of liability: Subject to the ongoing liability for death and personal injury though a negligent act, fraud and fraudulent misrepresentation or any matter for which we are not permitted by law to exclude or limit our liability, and the exclusion of business losses, our liability for damage to property or other goods is limited to [insert figure].

    Part B - This only applies to you if you are a business customer.

    1. Subject to the below, our liability under or in connection with these terms (regardless of whether such liability arises in tort, contract or in any other way and whether or not caused by negligence or misrepresentation) will not exceed the amount of £5,000,000.
    2. We will not be liable to you under or in connection with these terms (regardless of whether such liability arises in tort, contract or in any other way and whether or not caused by negligence or misrepresentation) for:
      1. consequential, indirect or special losses; or
      2. any of the following (whether direct or indirect): loss of profit; loss of opportunity; loss of savings, discount or rebate (whether actual or anticipated); or harm to reputation or loss of goodwill.
    3. Nothing in these terms will limit or exclude our liability for:
      1. death or personal injury caused by negligence;
      2. fraud or fraudulent misrepresentation; or
      3. any other losses which cannot be excluded or limited by law.
  13. COMMUNICATION
    1. We reserve the right to contact you by email, telephone, text message or post in order to:
      1. Confirm or otherwise any request for rental equipment
      2. Send reminders of the due date for return of any rental equipment
      3. Where any additional charges are being applied
      4. When we have made deductions from any deposit in accordance with these terms
    2. We will add any name and email provided as part of the account creation to our newsletter from which you can unsubscribe at any time.
    3. Any personal information that you provide to us will be dealt with in line with our Privacy Policy available here www.doddridgecentre.org.uk which explains what information we collect and hold about you, and how we collect, store, use and share such information.
  14. GENERAL TERMS
    1. Complaints: If you are unhappy with us please contact us at cd@doddridgecentre.org.uk.
    2. No transfer: You are not allowed to transfer your rights under these terms to anyone without our prior written and express consent. We may transfer our rights under these terms to another business without your consent, but we will notify you of the transfer and make sure that your rights are not adversely affected as a result.
    3. Severance: If any provision of these terms (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision of these terms will not be affected.
    4. Third-party: No one other than us or you has any right to enforce any of these terms.
    5. No waiver: If you breach these terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these terms.
    6. Law & Jurisdiction: If you are a consumer, the laws of England and Wales apply to these terms, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.
    7. If you are a business customer:
      1. these terms and any dispute or claim arising out of, or in connection with, the terms, their subject matter or formation (including non-contractual disputes or claims) will be governed by, and construed in accordance with, the laws of England and Wales. You and us both irrevocably agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, these terms, their subject matter or formation (including non-contractual disputes or claims).
      2. any variation to these terms will not be binding unless expressly agreed in writing between you and us.
      3. you and we both agree that these terms constitute the entire agreement between you and us in relation to your request. You acknowledge that you have not entered into these terms in reliance on any representation or warranty that is not expressly set out in these terms and that you will have no claim for innocent or negligent misrepresentation on the basis of any statement in these terms.

Liability Waiver and Indemnification Form

The items in our collection are for the use of The Doddridge Centre Borrow Hub members. Out of respect for future users, please take care of the items you borrow and report any damage to The Doddridge Centre Borrow Hub immediately. Though borrowers are responsible for damage that they have caused, we promise not to be angry. If you feel compelled to return them in better condition than when you borrowed them, that would be highly appreciated!

Your Statements – READ THIS CAREFULLY EVERY TIME YOU BORROW ANYTHING

I am capable and experienced in using the items I am borrowing, and that I will use the items I am borrowing in a safe and proper manner. I am aware that the Doddridge Centre Borrow Hub, its partners, directors, officers, members, volunteers and employees claim no expertise and make no representation concerning the fitness of any item for any particular use.

I, do hereby for myself, on behalf of my heirs, successors, and assigns, in consideration of being permitted to borrow tools, waive any and all claims against the Doddridge Centre Borrow Hub, its officers, agents, volunteers and employees for any injury or injuries of any nature that I may suffer or incur in the use of the item that I am borrowing from the Doddridge Centre Borrow Hub except those caused by a defect known to the Doddridge Centre Borrow Hub and not made known to me.

I agree to release and indemnify and hold harmless the Doddridge Centre Borrow Hub, its officers, agents, volunteers and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use or possession of items I am borrowing from the Doddridge Centre Borrow Hub.

I have read and fully understand and agree to the General T&C of The Doddridge Centre Borrow Hub and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.

SHORT: I'm responsible for how I use what I borrow, and I won't blame the AWESOME team behind the Doddridge Centre Borrow Hub for what I do with the items.
